Acceptance of These Terms

These Terms of Use ("Terms") are a legal agreement between you and EDUTrst LLC, a Kentucky limited liability company doing business as EDUTrust Network ("EDUTrust," "we," "us," or "our"). These Terms govern your access to and use of the websites, forms, and other online channels that we own or operate and that link to these Terms (collectively, the "Site"), and the education benefit services we provide through the Site (the "Services").

By accessing the Site, submitting an inquiry, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Site or the Services.

About the Services

EDUTrust administers an education benefit program that connects members of participating organizations and their families with accredited online degree and certificate programs offered by partner colleges and universities ("Partner Institutions"). When you submit an inquiry, we match your request with Partner Institutions whose programs fit your interests and deliver your inquiry to them so they can provide you with program information, as described in our Privacy Policy.

EDUTrust is not a college, university, or educational institution. We do not provide instruction, award credit or degrees, make admission decisions, determine tuition or fees, or administer financial aid. All educational services are provided by Partner Institutions under their own policies, catalogs, and enrollment agreements. EDUTrust receives compensation from Partner Institutions in connection with inquiries we deliver to them.

We are not an agent of any Partner Institution for purposes of admission, enrollment, or financial aid decisions, and no Partner Institution is our agent. Nothing on the Site creates an advisor, fiduciary, or counselor relationship between you and EDUTrust.

Eligibility

The Site and the Services are intended for adults exploring educational opportunities in the United States. You must be at least 18 years old, or the age of majority in your state, to submit an inquiry. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian, and no one under 16 may submit an inquiry.

Educational Information Disclaimers

Please read this section carefully. It describes the limits of the information we provide.

Program information comes from Partner Institutions and can change. Program descriptions, tuition rates, per-credit costs, fees, benefit pricing, program availability, start dates, admission requirements, transfer credit policies, and accreditation status are provided by or based on information from Partner Institutions and are subject to change at any time without notice. Before making any enrollment decision, verify all program details directly with the institution, including through its official catalog.

No guarantee of admission or enrollment. Submitting an inquiry does not guarantee admission to, or enrollment in, any program. Admission decisions are made solely by Partner Institutions under their own criteria.

No guarantee of financial aid, benefit eligibility, or cost. Statements about tuition savings, benefit rates, scholarship availability, or the potential application of federal or state financial aid, including Pell Grants, are general in nature. Your actual cost and aid eligibility depend on your individual circumstances and determinations made by the institution and the U.S. Department of Education. We do not provide financial aid advising, and nothing on the Site is financial, tax, or legal advice.

No guarantee of transfer credit. Whether prior credits, training, or experience will be accepted is determined solely by the receiving institution.

No guarantee of outcomes. We make no representation that any program will lead to employment, licensure, certification, promotion, salary increase, or any other outcome. Certain careers require licensure or certification with requirements that vary by state; confirm that a program meets the requirements of your state and profession before enrolling.

Your Responsibilities

When you use the Site or submit an inquiry, you agree that you will:

  • Provide information that is accurate, current, and complete, and that relates to you and not to any other person;
  • Provide only telephone numbers and email addresses that belong to you;
  • Use the Site only for its intended purpose of exploring educational programs and membership benefits for yourself or, where appropriate, your family member with their knowledge; and
  • Comply with applicable law in connection with your use of the Site.

You agree that you will not: use the Site for any unlawful or fraudulent purpose; submit inquiries containing another person's information without authorization; scrape, harvest, or collect data from the Site by automated means; interfere with the operation or security of the Site; attempt to gain unauthorized access to any systems or data; reverse engineer any portion of the Site; or use the Site to transmit malicious code.

Communications

The Site may offer you the opportunity to consent to receive communications from EDUTrust and Partner Institutions by email, telephone, or text message. The scope of those communications is described in the consent language presented where you provide your contact information and in our Privacy Policy. Your consent choices, and how to opt out, are governed by that consent language and the Privacy Policy. Standard message and data rates may apply to text messages.

Intellectual Property

The Site and its contents, including text, graphics, logos, page designs, and the selection and arrangement of content, are owned by EDUTrust or its licensors and are protected by copyright, trademark, and other intellectual property laws. Partner Institution names and marks belong to their respective owners, and their appearance on the Site does not imply endorsement of EDUTrust by any institution or of any institution by EDUTrust beyond the program relationship described.

We grant you a limited, revocable, non-exclusive license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, or create derivative works from the Site's content without our prior written permission.

Third-Party Websites and Content

The Site contains links to websites operated by Partner Institutions and other third parties. We do not control those websites and are not responsible for their content, accuracy, policies, or practices. Linking to a third-party website does not mean we endorse it. Your use of any third-party website is at your own risk and subject to that website's own terms and privacy policy.

Disclaimer of Warranties

THE SITE AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION ON THE SITE, INCLUDING PROGRAM AND PRICING INFORMATION PROVIDED BY PARTNER INSTITUTIONS, IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EDUTRUST AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, THE SERVICES, OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THE SERVICES ARE PROVIDED TO YOU WITHOUT CHARGE, AND YOU ACKNOWLEDGE THAT THIS LIMITATION IS A REASONABLE ALLOCATION OF RISK IN LIGHT OF THAT FACT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to indemnify and hold harmless EDUTrust and its members, managers, officers, employees, and service providers from and against any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to: (i) your violation of these Terms; (ii) your violation of applicable law; or (iii) information you submit through the Site, including any claim that information you provided about another person was submitted without authorization.

Dispute Resolution: Arbitration Agreement and Class Action Waiver

Agreement to arbitrate. You and EDUTrust agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Services, or communications you receive in connection with the Services, whether based in contract, tort, statute, or any other legal theory, will be resolved by binding individual arbitration rather than in court, except as stated below. This agreement to arbitrate is governed by the Federal Arbitration Act.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights. Nothing in this section prevents you from bringing issues to the attention of federal, state, or local agencies.

Class action waiver. YOU AND EDUTRUST EACH AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found unenforceable as to a particular claim, then that claim, and only that claim, must proceed in court, and the waiver remains in effect for all other claims.

Notice and informal resolution. Before initiating arbitration, you agree to first send us a written description of your dispute to the contact address below and allow 30 days for us to attempt to resolve it informally.

Opt-out right. You may opt out of this arbitration agreement and class action waiver by emailing privacy@edutrustnetwork.org within 30 days of first accepting these Terms, with your name, contact information, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other part of these Terms.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them are governed by the laws of the Commonwealth of Kentucky and applicable federal law, without regard to conflict of law principles. Subject to the arbitration agreement above, any claim that proceeds in court must be brought exclusively in the state or federal courts located in Fayette County, Kentucky, and you consent to the jurisdiction and venue of those courts.

Changes to the Site and These Terms

We may modify, suspend, or discontinue any part of the Site or the Services at any time, including the lineup of Partner Institutions and available programs. We may revise these Terms from time to time by posting the updated version on this page and updating the Last Updated date above. Material changes will apply prospectively. Your continued use of the Site after revised Terms are posted means you accept the revised Terms. If you do not agree to a revision, stop using the Site.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or where necessary to protect the Site, our users, or our partners. Sections of these Terms that by their nature should survive termination, including the disclaimers, limitation of liability, indemnification, dispute resolution, and governing law sections, survive termination.

General Provisions

These Terms, together with the Privacy Policy and any consent language you agree to on the Site, are the entire agreement between you and EDUTrust regarding the Site and the Services. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms; we may assign them in connection with a corporate transaction.
